Sea of Thieves coming soon to Steam
Sea of Thieves is now listed as “coming soon” to Steam, as Microsoft continues to offer more of its titles through Valve’s online marketplace.

An accompanying announcement said the Steam version of Sea of Thieves would support cross-platform play with other Windows PC users as well as Xbox One players.

“We’re genuinely thrilled to bring Sea of Thieves to Steam, and look forward to welcoming the Steam community to our game so we can share a grog and a shanty together and hear the tales of their adventures,” said Craig Duncan, studio head at Rare.
Rare’s rollicking, open-world pirate MMO launched in March 2018, exclusively on Windows PC and Xbox One through the Microsoft Store. A year later, Xbox chief Phil Spencer said the company would start to offer more of its Xbox Game Studios titles on Steam.

“We believe you should have a choice in where you buy your PC games,” Spencer said at the time.
Gears 5 and Halo: The Master Chief Collection later launched on Steam on the same date as their Windows PC and Xbox One releases. State of Decay 2 followed in mid-March 2019, a little under two years from its launch. Microsoft acquired developer Undead Labs shortly after that release.

Xbox Game Studios currently has 36 games listed on Steam, with another two, including Psychonauts 2, listed as coming soon.

Call of Duty games can depict Humvees without a license, says judge


A New York judge has ruled that publisher Activision isn’t infringing trademark by featuring Humvees in its Call of Duty series. The decision, handed down yesterday, is a mark in favor of game developers depicting actual military equipment to create a sense of realism.

Humvee maker AM General sued Activision in 2017, claiming Call of Duty players were “deceived into believing that AM General licenses the games.” Activision denied the claim, saying it had a First Amendment right to depict official military equipment in a war game. Using trademark to control creative work was “dangerous under any circumstance,” its lawyers wrote, “but the claims in this case are particularly egregious because they involve a US military vehicle paid for by American taxpayers and deployed in every significant military conflict for the past three decades.”

District court Judge George Daniels wrote that Activision’s games passed the “Rogers test,” referring to a 1980s ruling on the use of trademarked names in artistic works. “It was metaphysically possible for [Activision] to have produced video games without the presence of Humvees,” Daniels says. But they increase Call of Duty’s feeling of realism and serve a purpose beyond simply trading on the Humvee brand. “If realism is an artistic goal, then the presence in modern warfare games of vehicles employed by actual militaries undoubtedly furthers that goal.”

Moreover, Call of Duty beats the “Polaroid factors” standards that determine whether a trademark’s use will confuse consumers. “Put simply, [AM General’s] purpose in using its mark is to sell vehicles to militaries, while [Activision’s] purpose is to create realistically simulating modern warfare video games for purchase by consumers.”

But for years, major studios hesitated to include real firearms or other military gear without approval, although they began dropping official licensing deals in response to pressure from gun control advocates. In 2013, EA settled a suit with helicopter maker Bell Textron over its game Battlefield 3.

This is the second legal victory for a games studio this week — after publisher Take-Two prevailed in a lawsuit over whether it could depict LeBron James’ tattoos in the NBA 2K franchise.

Gearbox employees reportedly denied promised Borderlands 3 royalty bonuses


Gearbox Software employees were reportedly denied promised royalty bonuses linked to Borderlands 3, despite the looter shooter’s massive sales success.

Gearbox CEO Randy Pitchford told employees that they will receive bonuses, but nowhere near the up to hundreds of thousands that many expected, Kotaku reported, citing six anonymous sources close to the studio.

Employees of Frisco, Texas-based Gearbox receive below-average salaries compared with peers in other studios, former and current staff have told Kotaku over the years. The draw for working for the Borderlands developer is its profit-sharing scheme, with 40% of the royalties from its games distributed to employees as quarterly bonuses. For 2012’s Borderlands 2, many Gearbox workers reportedly received enough money to buy houses.

The bonuses have since been smaller due to the struggles of 2013’s Aliens: Colonial Marines and 2016’s Battleborn, but Borderlands 3 was expected to turn things around for the studio. Several employees told Kotaku that Gearbox management promised six-figure bonuses, which kept them motivated when working many long nights and weekends to finish the third installment in the series.

Pitchford, however, told employees in a meeting that the Borderlands 3 bonuses will be significantly lower than promised, three sources told Kotaku, as the game cost more to make than planned largely due to the switch mid-way during development from Unreal Engine 3 to Unreal Engine 4, and because the company has grown larger with the addition of a second studio in Quebec, Canada. Pitchford also said that sales projections for Borderlands 3 were off-base.

According to people who were in the meeting, Pitchford also told employees that if they were not happy with the studio’s royalty system, they were welcome to leave.

The promised Borderlands 3 bonuses made a “golden handcuffs situation,” Eurogamer reported, citing sources close to the studio, as developers were forced to stay until the game was completed in order to collect their expected royalties. With the bonuses now handed out, a mass exodus of employees from Gearbox may happen, according to Eurogamer.

In response to Kotaku’s report, Gearbox issued the following statement:

“Borderlands 3 represents an incredible value to gamers and an incredible achievement by the team at Gearbox Software. Our studio is talent-led and we believe strongly in everyone sharing in profitability. The talent at Gearbox enjoys participation in the upside of our games –a to our knowledge, the most generous royalty bonus system in AAA. Since this program began, Gearbox talent has earned over $100M in royalty bonuses above and beyond traditional compensation.

“In the most recent pay period Gearbox talent enjoyed nesws that Borderlands 3, having earned revenue exceeding the largest investment ever made by the company into a single video game, had officially become a profitable video game and the talent at Gearbox that participates in the royalty bonus system has now earned their first royalty bonus on that profit. Additionally, a forecast update was given to the talent at Gearbox that participates in the royalty bonus to set expectations for the coming quarters. Gearbox is a private company that does not issue forward-looking statements to the public, but we do practice transparency within our own family.”
